The Department of Business Innovation and Skills (BIS) has recently launched a call for evidence to gather information on the use of non-compete clauses in employment contracts (click here for our previous article). The call for evidence closed for responses on 19th July 2016. Prior to this the ARC published a briefing note (click here to access) on the call for evidence and issued a short survey to our members asking them to provide us with their views on, and experience of, non-compete clauses.

Conclusively, our members responded in the affirmative to seeing the value in non-compete clauses and in the negative to confidentiality and intellectual property rights being enough protection. However, our members would welcome guidance on the use of non-compete clauses.
