ARC's Approach
To represent well it is necessary to ensure that principles are
established, that there is no ambiguity in approach or conflict of
interest which could undermine the purpose, that the best interests of
members are clear. Then and only then can you present the case in the
strongest possible way.
ARC is not affected by political
considerations nor does it represent non recruiter organizations,
leaving it able to represent openly and without the potential conflicts
that can exist elsewhere. Further, ARC has retained Lawspeed to advise
in this area. Lawspeed has a significant and successful track record in
achieving results from representation, leading to key wins for the
industry.
A classic example was the achievement of an opt out for
limited company contractors under the 2003 Conduct Regulations, first
proposed by Lawspeed to government in 2001. Lawspeed’s unique
involvement in the industry, which combines both a legal and a
commercial approach, is a superb asset for any recruiter needing
representation.
Why does this matter? Because as we all know
agency work offers flexibility and advantages to hirers, agencies and
workers alike. Yet after years of damaging legislation and increasing
bureaucracy, with more on the way, the concept and the industry is
under greater threat than ever before. This must raise the question
whether recruiters have had the best possible representation.
Whatever the answer, ARC believes a new more determined approach is essential,
to stem and if possible reverse the tide of legislation,
administration, and (in some cases) unnecessary compliance that
threatens to strangle this crucial industry.
